DUI Defense in Western Kentucky
A DUI arrest is frightening. One traffic stop can threaten your driver's license, your job, your reputation — and your freedom. If you've been arrested for driving under the influence in western Kentucky, you need a lawyer who actually tries these cases, not one who just pleads them out.
I'm Ryan Driskill. I defend DUI cases — alcohol and drugs — in Muhlenberg, McLean, Hopkins, Daviess, Ohio, Butler, and surrounding counties. I know how these cases are built, because I've tried them sometimes winning and sometimes not. I've represented many individuals in which the charges were dropped or amended.
Kentucky DUI penalties are serious — even the first time
A first-offense DUI in Kentucky (KRS 189A.010) can mean jail time, fines and court costs, a license suspension of 30 to 120 days, and mandatory alcohol or substance abuse education. A second offense within ten years brings mandatory jail time. Aggravating factors — a high blood alcohol reading, a child in the vehicle, or causing injury — make everything worse.
And a DUI conviction stays on your record. It raises your insurance rates for years and shows up on every background check an employer runs.
Why DUI cases can be beaten
Most people assume a DUI arrest means a DUI conviction. Prosecutors count on that assumption. But DUI cases are among the most defensible criminal charges in Kentucky:
- The stop itself. Police need a lawful reason to pull you over. If the stop was illegal, everything after it — including the breath or blood test — can be thrown out.
- Field sobriety tests. The roadside tests (walk-and-turn, one-leg stand, horizontal gaze) were validated for alcohol, not for marijuana, methamphetamine, or prescription drugs. They are scored subjectively, on the shoulder of a road, often at night. I challenge the officer's training and the conditions of every test.
- Breath and blood tests. Machines malfunction. Samples get mishandled. Chain of custody breaks down. In DUI-drugs cases, Kentucky has no per se THC limit — the state must prove actual impairment, and a positive blood test alone doesn't do that.
- Your statements. What you said on the roadside matters enormously. Whether those statements were voluntary, and whether you were in custody when you made them, can decide the case.
I've defended clients facing DUI charges involving alcohol, marijuana, methamphetamine, and prescription medications. I look for the flaw in the state's case — and in DUI cases, there usually is one.
What to do right now
- Say nothing else to police or prosecutors. Be polite, but stop talking about the facts.
- Write down everything you remember — where you were stopped, what the officer said and did, what tests were given, and in what order. Details fade fast.
- Watch the calendar. License suspension deadlines and court dates come quickly in Kentucky. Missing one can cost you your license by default.
- Call a lawyer before your first court date. The earlier I get involved, the more options we have — including challenging the stop, the tests, and the evidence before the prosecution locks in its position.
Frequently asked questions
Will I lose my license after a DUI arrest in Kentucky?
Possibly, and quickly. Kentucky can suspend your license administratively, separate from the criminal case. There are strict deadlines to challenge a suspension, which is why you should talk to a lawyer immediately — not after your first court date.
Is a DUI for drugs different from a DUI for alcohol?
Yes, and in some ways it's easier to defend. Kentucky has no legal THC limit the way it has a 0.08 limit for alcohol. For a DUI-drugs conviction, the Commonwealth must prove you were actually impaired — and the field sobriety tests police rely on were never validated for drugs.
Should I just plead guilty to a first-offense DUI?
Almost never without having a lawyer review the case first. I've seen first-offense DUIs reduced or dismissed over bad stops, bad tests, and bad blood draws. A guilty plea is locking in your penalty and a guaranteed loss of your money (and maybe your freedom). A consultation is free.
How much does a DUI lawyer cost?
I handle most DUI cases for a flat fee, quoted up front — no surprises, no hourly meter running. Call and I'll tell you exactly what your case would cost.
